A senior judge ruled that the radical cleric could not be extradited on the basis that Jordan had not proved that evidence obtained by torture would not be used against him in a retrial.
"As we have said, the government strongly disagrees with Siac's ruling, and we remain committed to deporting this dangerous man," a Home Office spokesman said.
The preacher faces a re-trial in Jordan for conspiring to cause explosions targeted at the West and Israel, and is believed to have played a key role in spreading support for suicide bombings in Europe.
